Paul G. Garjian is a member of the bar in the states of New York and New Jersey. Mr. Garjian has counseled and represented individuals and entities in many area of the law, including contract matters, construction and real estate litigation, criminal defense, divorce and family law matters, guardianships, and estate litigation. He has been appointed by the Superior Court of New Jersey to serve as Guardian, Guardian ad Litem, as well as to represent the interests of incapacitated persons.

We have experience mediating and settling cases in which family members dispute the validity of a will or power of attorney, including lack of capacity and undue influence. We have argued many cases in court where the parties are unable to come together or resolve their dispute.

Mr. Garjian has trained extensively as a mediator in New York and New Jersey. He has mediated well over a thousand cases utilizing various techniques to help the parties achieve a resolution or settlement. He has concentrated on and successfully mediated settlements in contract and construction disputes, divorce, employment law matters (wrongful termination, discrimination, Title 9 etc.), and estate disputes. In 2009, he was selected and continues to serve as one of the few Foreclosure mediators in New Jersey. He is assigned to one county in New Jersey and also covers four others.
Mr. Garjian has trained extensively as an arbitrator of over a 100 cases in state court as well as for the Financial Industry Regulatory Authority (“FINRA”). He has arbitrated over a hundred cases. He is classified as a non-public arbitrator for FINRA because of his history as a former employee of the predecessor in interest to Morgan Stanley (formely Citi Smith Barney and Morgan Stanley Smith Barney). He is court approved arbitrator in New york and New jersey State court.
There are several concerns when engaged in residential or commercial construction. Parties often prioritize completing a project on time and within budget. This emphasis can often become harrowing, resulting in such claims as regulatory or licensing non-compliance by contractors, allegations against local governments (municipalities and zoning boards), violations of the Consumer Fraud Act, construction contract breaches, claims relating to defective goods and materials used in such construction or other allegations. Mr Garjian became familiarized with the most talented architects, engineers, contractors, and sub-contractors in their particular arenas and has resources with whom to collaborate.
There are many reasons for family members or close friends to file for guardianship. Some children have developmental disabilities, which are a group of conditions due to an impairment in physical, learning, language, or behavior areas. These conditions begin during the developmental period, may impact day-to-day functioning, and usually last throughout a persons lifetime.
Adults may wind up developing conditions which prevent them from being able to manage their affairs, care for themselves, or continue to live independently. Depending on the type of disability, whether neurological, cognitive, or another form of disability, it is usually necessary for someone, be it family or close friends, to seek approval for the person to have a guardian. The guardian will protect the person and his/her property, and otherwise manage the health and affairs of the disabled in the best interests of such person. We have experience representing allegedly incapacitated persons (“AIP’s”), acting as Guardian, Guardian ad Litem, and Court Evaluators (to be the eyes and ears of the Court).

Mr. Garjian has tried many cases to successful verdicts over the years. Being cognizant of the costs and other issues involved, he has become a champion and vigorous proponent of alternate dispute resolution (“ADR”) – i.e. mediation and arbitration. Mr. Garjian has undergone extensive training as a mediator and as an arbitrator by well respected leaders in the ADR field. He has mediated well over 3500 cases. He has served as a mediator for the parties in commercial and contract litigation, divorce, employment law litigation (wrongful termination, discrimination, Title 9 etc.), and estate disputes. Since 2009, he was selected and has continued to serve as a FINRA arbitrator and is now classified as a “non-public” arbitrator because of his history as a former employee of the predecessor in interest to Morgan Stanley Smith Barney.
Mr. Garjian was selected as a Part 36 Panelist pursuant to the Rules of the Chief Judge in New York and is listed on the panel for Article 81 Guardianships. He was a Director of the New Jersey State Bar Association Alternate Dispute Resolution Section through summer of 2020 and is an active member of the New York City Bar Association, the New York State Bar Association, and the Association of Conflict Resolution of Greater New York (“ACR-GNY”).
Mr. Garjian has a history of community involvement as well. He served as Borough Councilman for fourteen years and was Commissioner of the Department of Public Works (“DPW”) during his tenure. He also was appointed Insurance Commissioner for many years and the Board of Education liaison to the borough council. He served on the COAH committee regarding affordable housing issues mandated by New Jersey court decisions.
I represent clients effectively in civil matters, including construction law, contracts, divorce and family law matters, estate disputes, and guardianships. Being a Court-Approved Mediator, I have successfully mediated well over 3,500 cases. I am fully familiar with various mediation techniques to facilitate the parties and their counsel to reach a settlement of their cases. Many of such cases include commercial litigation, construction litigation, employment law and Title 7 litigation matters, and family law and estate disputes. I also mediate foreclosure cases as Foreclosure Mediator with the New Jersey Office of Dispute Settlement.
